Privita is a privacy-first technology platform that facilitates voluntary gifts between supporters and content creators. Privita does not hold funds, guarantee any outcome, or accept liability for transactions processed by Stripe.

1. Acceptance of Terms

By accessing or using Privita ("the Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all users — supporters and creators alike.

2. Eligibility

You must be at least 18 years of age to use Privita. By using the Platform, you represent and warrant that you meet this requirement. We reserve the right to terminate accounts of users who do not meet this requirement.

3. What Privita Is

Privita is a technology platform that provides:

• A privacy layer between supporters and content creators

• A mechanism for supporters to send voluntary gifts to creators identified by a PV code

• Payment processing via Stripe, a third-party payment processor

Privita does not employ creators, curate content, or guarantee the relationship between any supporter and creator. Privita is not a bank, financial institution, or money transmitter. All payment processing is handled exclusively by Stripe.

4. Voluntary Gifts

All transactions on Privita are voluntary gifts from supporters to creators. By completing a payment, you acknowledge that:

• The gift is voluntary and made of your free will

• No specific service, content, or deliverable is promised or owed in return

• Gifts are non-refundable except as required by applicable law

• Privita does not guarantee any response, acknowledgement, or action from the recipient creator

5. Platform Fee

Privita charges a platform fee on each gift transaction. The current fee is 15% of the gift amount, retained by Privita before the remainder is transferred to the creator. This fee is subject to change with reasonable notice. The creator receives the balance after Stripe's processing fees and Privita's platform fee are deducted.

6. Creator Responsibilities

Creators who register on Privita agree to:

• Provide accurate information during Stripe Connect onboarding

• Comply with all applicable laws and tax obligations in their jurisdiction

• Not use Privita as a mechanism to receive payment for services, adult content, or any prohibited activity

• Manage their chargeback disputes as Merchant of Record on Direct Charge transactions

7. Prohibited Uses

You may not use Privita to:

• Receive payment for services, subscriptions, or content deliverables

• Circumvent any applicable financial regulations

• Engage in fraud, money laundering, or any illegal activity

• Harass, threaten, or abuse any other user

• Use automated systems to generate transactions

Violation of these prohibitions may result in immediate account termination and reporting to relevant authorities.

8. Privacy

We take privacy seriously. Supporters and creators are never required to share personal financial or contact information with each other. Please review our Privacy Policy for details on how we collect and use your information.

9. Termination

Privita reserves the right to suspend or terminate any account at any time, for any reason, with or without notice. You may also delete your account at any time by contacting us at info@privita.online.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Privita shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability in any matter arising from these Terms shall not exceed the total fees paid by you to Privita in the twelve months preceding the claim.

11. Dispute Resolution

Any dispute arising from these Terms shall be resolved by binding arbitration in Ontario, Canada, under the rules of the ADR Institute of Canada. You waive any right to a jury trial or class action proceeding.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. We will make reasonable efforts to notify users of material changes.
